Claims and Changes Management

Claims and Changes Management is an interdisciplinary area of expertise that overlaps with Cost Engineering, Planning and Delay Analysis, Contract Administration and Legal Expertise.

Most of the standard contract forms stipulate submission of a claim document by the parties in order to protect their contractual rights within a defined period of time.

Moreover, changes are generally managed in accordance with formal contract change or variation procedure. However, management of changes can be a problem in complex large scale projects where consequences of change cannot be estimated until the net impact of the change comes to light.

Claims and Changes Management depends upon the proper implementation of Contract Administration, Planning and Delay Analysis and Cost Management processes. For example, if the Contractor fails to issue claim notices on time, it would lose its contractual rights under most of the standard forms of contracts Similarly, if the Contractor fails to record its costs properly, it cannot calculate prolongation or disruption costs in its claim document. Moreover, if the Contractor fails to show Employer culpable delays in its monthly schedule updates, it could be in a position to lose its contractual rights to extension of time. Therefore, these processes must be carried out with a special focus on Claims and Changes Management.

Claims and Changes Management, in this context, includes the following tasks:

* Supervision of Cost Management, Planning and Delay Analysis and Contract Administration processes to ensure that they are carried out with a special emphasis on Claims Management,

* Analysis of delays by employing an accepted Prospective or Restrospective delay analysis method in cooperation with the Planning Department,

* Calculation of prolongation costs with the support of Planning and Cost Control Departments,

* Calculation of disruption costs together with the Cost Control Department,

* Preparation of fully detailed Claim Documents and presentation in collaboration with Contract Administration Department, and

* Preparation of replies and defences to counterclaims and rebuttals.
